Sales & Checkout Terms

These Sales & Checkout Terms govern purchases of physical goods, digital items, QR-code orders, and shop-and-deliver transactions completed through kimtechsolution.com and our partner storefronts. They apply in addition to our Terms of Service and Refund Policy. If there is a conflict, these Sales Terms control for the specific purchase.

1. Parties to the sale

When you buy an item listed by KimTechSolution, the seller is KimTechSolution. When you buy an item listed under the name of a partner shop in our directory, catalog, or QR-code menu, the seller is the partner merchant. In either case, KimTechSolution may act as the payment collection agent and as the delivery carrier.

2. Orders & acceptance

  • Your submission of an order is an offer to purchase. A binding contract is formed only when we (or the partner merchant) send an order confirmation, or when fulfillment begins.
  • We may decline or cancel any order — including after payment — for reasons such as pricing errors, suspected fraud, unavailable stock, or delivery outside our service area. In that case the full amount paid is refunded.
  • Quantities may be limited. We may impose per-customer purchase limits at our discretion.

3. Prices, taxes & currency

  • All prices are shown in Guyanese Dollars (GYD) unless otherwise stated. Where USD pricing is displayed, conversion is done at the prevailing rate at checkout.
  • Prices include applicable VAT/consumption tax where required by law. Delivery fees, service fees, and surcharges are shown separately before payment.
  • In the rare case of a pricing error, we may cancel the order and offer the correct price; you are not obligated to proceed.

4. Payment

  • Accepted methods: cash on delivery, MMG, bank transfer, and approved card payments.
  • Card payments are processed by third-party PCI-DSS-compliant providers. We do not store full card numbers on our servers.
  • COD orders require valid contact details. We reserve the right to verify orders by phone or WhatsApp before dispatch.
  • Chargeback abuse, repeated COD refusals, or unpaid balances may result in account suspension and recovery action.

5. Fulfillment, delivery & risk of loss

  • Estimated dispatch and delivery times are shown at checkout. They are estimates and not guarantees.
  • Title to and risk of loss for purchased goods pass to the buyer upon delivery to the address provided, or upon collection at a designated pickup point.
  • For shop-and-deliver orders, our driver acts as your agent for the in-store purchase. Substitutions are made only when you authorize them.
  • You are responsible for inspecting the goods at delivery and noting any visible damage or shortage on the proof-of-delivery before signing.

6. Product warranties

  • Manufacturer warranties (where offered) pass through to the buyer. KimTechSolution does not extend or assume any additional warranty unless expressly stated on the product page.
  • All goods are sold "as described". Statutory consumer rights under Guyana law are not affected.
  • Perishable and food items are sold for immediate consumption and carry no warranty beyond fitness at the time of delivery.

7. Returns & refunds

Return windows, eligible items, and refund timelines are governed by our Refund & Cancellation Policy. In summary:

  • Damaged or incorrect items: report within 48 hours for free replacement or refund.
  • Change of mind on eligible items: return within 7 days, unopened, with a 10% restocking fee.
  • Non-returnable categories include perishables, personal-care items, customized goods, and final-sale items.

8. Promotions, vouchers & loyalty

  • Promo codes, vouchers, and Reward Network credits are non-transferable, have no cash value, and cannot be combined unless stated.
  • Vouchers obtained through fraud, multiple-account abuse, or unauthorized redistribution will be voided.
  • We may modify or end any promotion at any time. Loyalty points expire 12 months after issue if the account is inactive.

9. Age-restricted goods

Some products (such as tobacco or alcohol where available) are restricted to buyers aged 18 or over. Our driver may request government-issued ID at delivery and may refuse to release the item without affecting your liability for the order total minus the cost of returned restricted goods.

10. Partner-shop listings & IP

Partner merchants are responsible for the accuracy of their listings, photos, prices, and product descriptions, and for ensuring they have the right to sell the items listed. We may remove listings that infringe third-party rights or violate these Terms.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with any single sale is limited to the amount paid by you for the items in that order. We are not liable for indirect, incidental, or consequential damages.

12. Governing law

These Sales Terms are governed by the laws of the Co-operative Republic of Guyana. Disputes are resolved as set out in our Terms of Service.
