1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between you and KimTechSolution ("KimTech", "we", "us", "our"), a delivery and logistics business operating in the Co-operative Republic of Guyana. By accessing kimtechsolution.com, using our mobile or WhatsApp booking channels, or receiving any of our delivery, freight, or fulfillment services, you confirm that you have read, understood, and agree to be bound by these Terms.

If you are using the service on behalf of a company, you represent that you have authority to bind that company. If you do not agree to any part of these Terms, you must stop using the service immediately.

2. Services We Provide

KimTechSolution offers a connected suite of logistics services in and into Guyana. Specific service descriptions, coverage areas, and rates are published on the relevant pages of our website and may be updated from time to time:

  • Same-day & scheduled last-mile delivery across Georgetown, the East Bank, East Coast, West Coast, Linden, Berbice, and select interior locations.
  • Parcel and document pickup on demand or on recurring routes.
  • Laparkan-to-door collection from Laparkan Guyana warehouses with door delivery anywhere in country.
  • Freight forwarding (air and sea) from California, New York, and Miami to Guyana, including consolidation, customs clearance coordination, and last-mile delivery.
  • Business logistics: dedicated dispatch, daily runs, dashboards, invoicing, cash-on-delivery (COD) collection, and reverse logistics for partner merchants.
  • Warehousing & fulfillment: short and long-term storage, pick-and-pack, and order fulfillment for ecommerce sellers.
  • Last Mile Shared Ride and driver network services connecting customers, packages, and businesses.
  • Retail tools: QR-code ordering, storefront listings in our directory, and lightweight checkout for partner shops.

We may engage independent contractors, partner couriers, and third-party carriers (collectively, "Service Partners") to perform any portion of a job. We remain your point of contact and are responsible for coordinating the service we accept.

3. Accounts & Eligibility

You must be at least 18 years old to create an account or book a service. You agree to provide accurate, current, and complete information, to keep your password confidential, and to notify us immediately of any unauthorized use. You are responsible for all activity that occurs under your account, including bookings placed via WhatsApp using your registered phone number.

We may suspend or terminate any account that is used for fraud, abuse, repeated chargebacks, harassment of drivers or staff, or violation of these Terms.

4. Bookings, Quotes & Estimates

Fees and ETAs displayed at booking are estimates based on the information you provide (origin, destination, package size, weight, urgency, and time of day). Final charges may adjust to reflect actual distance traveled, waiting time, multiple stops, vehicle class changes, after-hours surcharges, return trips, failed delivery attempts, tolls, or other costs incurred to complete the job.

For freight quotes, all rates are valid for 7 days unless stated otherwise and are subject to confirmation of weight, dimensions, commodity type, and current carrier tariffs. Customs duties, taxes, port fees, demurrage, storage, and government charges are not included in our quoted service fee unless explicitly listed.

5. Customer Obligations

  • Provide accurate pickup and drop-off addresses with a reachable phone number.
  • Ensure someone is available to release goods at pickup and receive them at drop-off during the agreed window.
  • Package items securely. Fragile, perishable, or temperature-sensitive items must be clearly labeled. We are not liable for damage caused by inadequate packaging.
  • Truthfully declare the contents, weight, and value of each shipment. Misdeclaration voids our liability and may result in additional charges or legal reporting.
  • Obtain any permits, licenses, or regulatory approvals required for the goods being shipped.

6. Prohibited & Restricted Items

You must not tender, and we will not knowingly transport, any of the following without prior written approval and lawful documentation:

  • Firearms, ammunition, explosives, fireworks, and weapons of any kind.
  • Illegal drugs, controlled substances, and any item the possession or transport of which is prohibited under Guyana law or the laws of any country of origin/transit.
  • Hazardous materials (HAZMAT): flammable liquids/gases, corrosives, radioactive materials, lithium batteries above carrier limits, mercury, pesticides.
  • Currency, negotiable instruments, gold, precious stones, and bullion.
  • Live animals, human remains, and biological/medical waste.
  • Counterfeit goods, stolen property, and items that infringe intellectual property rights.
  • Pornographic material involving minors or any other unlawful content.

We may refuse, hold, open, inspect, return, or surrender to authorities any shipment we reasonably believe contains prohibited items, at your cost and without liability to us.

7. Pricing, Payment & Cash-on-Delivery

Prices are quoted in Guyanese Dollars (GYD) unless otherwise stated. Accepted payment methods include cash, MMG, bank transfer, and approved card payments. Business accounts may be invoiced on net-7 or net-14 terms after credit approval.

For Cash-on-Delivery (COD), our driver collects the agreed amount on your behalf at the time of delivery and remits collected funds to your registered account on the next business day after deducting our service fee and any COD handling charge disclosed at booking. We are not liable for counterfeit currency, short payments accepted by the recipient, or amounts collected against your written instruction.

Overdue invoices accrue late fees of 2% per month or the maximum permitted by law, whichever is lower. We may suspend service on accounts with overdue balances.

8. Delivery Windows & Failed Attempts

Delivery times are estimates and are not guaranteed unless we agree in writing to a specific time-definite service. Weather, road closures, flooding, traffic, customs delays, force majeure, and acts of third parties may extend delivery times.

If the recipient is unavailable, the address is unreachable, or access is refused, our driver will attempt to contact you for up to 15 minutes. After that the package may be returned to our facility and a redelivery or return fee will apply.

9. Liability & Insurance

Subject to applicable law, our maximum liability for any loss, damage, or misdelivery of a shipment is the lesser of (a) the declared and documented value of the goods, or (b) GYD 50,000 per shipment for local deliveries and USD 100 per kilogram for freight shipments, unless additional carriage insurance has been purchased through us and confirmed in writing prior to pickup.

We are not liable for: (i) consequential, indirect, or incidental damages including lost profits or business opportunity; (ii) damage caused by inadequate packaging, inherent defect, or natural deterioration of perishable goods; (iii) loss or damage caused by acts or omissions of customs, port, or government authorities; (iv) delays or losses caused by events of force majeure (defined below); or (v) any shipment tendered without a proper declared value.

Claims must be submitted in writing within 7 days of delivery (for damage or shortage) or within 30 days of the expected delivery date (for non-delivery), with supporting documentation and photographs. See the Refund Policy.

10. Force Majeure

Neither party is liable for any failure or delay in performance to the extent caused by events beyond its reasonable control, including acts of God, severe weather, flooding, pandemics, civil unrest, strikes, labor disputes, war, terrorism, government action, internet or utility outages, port or airport closures, and failures of upstream carriers.

11. Cancellations & Changes

Bookings may be modified or cancelled without charge before a driver is dispatched. Once a driver has been dispatched, a cancellation fee of up to 100% of the trip base fare may apply. Changes to destination or stops mid-route are billed at our standard distance rate. Freight bookings already manifested to a carrier are subject to that carrier's cancellation tariff.

12. Drivers & Partners

Drivers and Service Partners are independent contractors, not employees, unless expressly stated. They are responsible for their own vehicles, insurance, taxes, and traffic compliance. We onboard drivers through identity verification, license checks, and references, and we may suspend or remove any partner who breaches our code of conduct.

Customers agree to treat drivers and dispatch staff with respect. Harassment, discrimination, threats, or violence will result in immediate account termination and may be reported to authorities.

13. Intellectual Property

All content on kimtechsolution.com — including text, graphics, logos, the "KimTechSolution" and "Kimtech" names, software, and the underlying platform — is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as permitted for personal, non-commercial use of the website.

14. Acceptable Use of the Platform

  • No scraping, reverse engineering, or automated access without written permission.
  • No use that interferes with the security or operation of our systems.
  • No fraudulent bookings, fake addresses, or impersonation.
  • No use of the platform to send spam, phishing, or unlawful communications.

15. Third-Party Services

Our platform integrates third-party services (such as mapping, SMS, WhatsApp, payment processors, and carrier APIs). Your use of those services is also subject to their terms. We are not responsible for the availability or accuracy of third-party services.

16. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

17. Indemnification

You agree to indemnify, defend, and hold harmless KimTechSolution, its officers, employees, drivers, and partners from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) the contents of any shipment you tender to us.

18. Suspension & Termination

We may suspend, restrict, or terminate your access to the service at any time for breach of these Terms, suspected fraud, abuse, or any conduct that may harm other users, our drivers, or our business. Sections that by their nature should survive termination (including Liability, Indemnification, IP, and Governing Law) will survive.

19. Governing Law & Disputes

These Terms are governed by the laws of the Co-operative Republic of Guyana, without regard to its conflict-of-law principles. The parties first agree to negotiate in good faith for 30 days. Any unresolved dispute will be submitted to the exclusive jurisdiction of the courts of Guyana sitting in Georgetown.

20. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the latest changes took effect. Material changes will be communicated through the website, by email, or via WhatsApp where appropriate. Your continued use of the service after changes are posted constitutes acceptance.
